Many employers want to include a probationary period in an initial employment contract. For example, both the employer and you, the employee, can "try out" each other and see whether a working relationship is desirable for a longer period of time. There are limitations to a probationary period according to the Work and Security Act. The employer must comply with the Work and Security Act when agreeing to it.

The law stipulates that for contracts up to one year a probationary period of up to one month may be agreed and for contracts that last longer two months. This rule may be deviated from by means of a collective labour agreement and many collective agreements therefore stipulate that a probationary period may also last two months in the case of fixed-term contracts. A probationary period must be agreed in writing and in the event of a longer probationary period than permitted, there is no probationary period at all. In the event of an extension of a contract, no probationary period may be agreed.
