Consumer law: You as a consumer enjoy many rights under Dutch law, but are you aware of all your rights?
Whether it's a washing machine that breaks down in or after the "warranty period" indicated by the seller, your car that has been repaired but still makes a weird noise, your new shoes are not beautiful and you want to return them or you have ordered something over the phone that you regret afterwards,  these are some examples of disputes for which you can contact us.

Everyone who buys something, whether it is via the internet, in the store or at the door, has rights. But what rights do you have? What can you expect from your new purchase? What can you do if your purchase doesn't meet expectations? Unfortunately, consumers are often not well informed about their rights or the consumer is informed differently by the seller, or they do not want to pay the high lawyer's fees to help them. We want to change this by offering affordable legal services for consumers. Often the seller knows that he is wrong, but also that the consumer will not continue if the seller does not cooperate. By means of a good letter of complaint and the right arguments, you as a consumer have a high chance of success in many disputes.

Why consumer law?
You may wonder why special rules have been created for consumers. This has to do with the fact that when concluding a contract with a professional party, the consumer is usually 'the weaker party'. Most consumer law rules are aimed at providing more protection for consumers. They predominantly apply to relationships between a consumer and a professional party. Current consumer law was largely established under the influence of the European Union.

What does consumer law regulate and where can the rules be found?
Consumer law provides rules that define the rights, and sometimes also obligations, of the consumer in trade. These rules cover a wide range of areas. Think of: purchase, distance purchase, door-to-door sales, taking out an (energy or telephone) subscription, insurance, arrangements in the travel industry, etc. Because consumer law covers a wide range of areas, the regulations are also spread over various laws. Examples are the Civil Code, the Telecommunications Act, the General Data Protection Regulation, etc. Most of the rules of consumer law are mandatory: they may not be deviated from.

Consumer law often mandatory law
Most rules in consumer law are mandatory. This means that this may not be deviated from to the detriment of the consumer. If a company deviates from these rules, for example through its general terms and conditions, then these conditions are not legally valid.

Notice of default
As a consumer, you have the right to a proper product or service. If after the purchase it appears that the purchased product or service is faulty, then there is a breach of contract. If there is a breach of contract, you are entitled to a free repair or replacement of the product or service. If you want to appeal to this, you as a consumer must first give the seller a default. If the seller does not want to repair or replace the product or service, it is possible to dissolve the purchase agreement or contract and possibly claim compensation.
