Drawing up a rental agreement
If you want to rent out your home, you must draw up a rental contract. It contains agreements about the rent, the method of payment and a description of the living space. It is possible to (re)rent a house in the free sector, social rent or a temporary home according to the vacancy law. The rules for the rental of a property are very strict and tenants almost always enjoy rent protection. A mistake in the rental contract is easily made and can cause many problems. Pay enough attention to it to avoid rental disputes. Are you unsure about the contract you are offered? The lawyers of AGA Lawyers are happy to give you advice or draw up the rental agreement for you.

What can our lawyers help you with?

We can help you with almost all rental issues. Below we list a number of examples.

  • Entering into a rental agreement
The content of the lease largely determines your rights and obligations. Have the rental agreement drawn up or at least assessed by our specialists.
  • Is rental for a temporary period possible As a
landlord, you do not want to be permanently tied to a tenant. So what are the possibilities? To what extent is temporary rental possible?
  • Rent increase
You are a tenant and do not want to agree with the rent increase. Or you are a landlord and want to implement a rent increase.
  • Defects in the rented
property You are a tenant and the rented property has serious defects. Can you suspend or reduce the rent payment? How can I force the landlord to repair the defects? You are a landlord and are confronted with a tenant who no longer wants to pay the rent due to defects.
  • Substitution and home exchange
You rent a business space and transfer the rental right to the buyer of your company. Or you rent a house and want to do 'home exchange'.
  • Subletting
When is subletting possible? What rights do the subtenant have?
  • Unlawful use of rented property What can you do as a landlord if the tenant has left the rented property and you are confronted with  other users?
  • Airbnb
Is  Airbnb  (holiday rentals) allowed? And what about Bed &  Breakfast? What are the rights of tenant and landlord?
  • Can I rent out my property to several tenants at the same time?
You are wondering whether you can rent out your property to a group of tenants (e.g. students). How about that? What is the best way to do this?
  • Renovation
Your business premises or home will be renovated. Do you have to agree to that? Who pays for the damage and does more rent have to be paid?
  • Rent arrears
Your tenant does not pay the rent and you want to proceed to collection and eviction.
  • Rent cancellation
Your rent will be terminated or you want to cancel the rent. Is that possible? How can this be done? Is there a right to rent protection  or eviction protection?
  • Etc.

If you want to rent out your home, you must draw up a rental contract. It contains agreements about the rent, the method of payment and a description of the living space. The rules for the rental of a property are very strict and tenants almost always enjoy rent protection. A mistake in the rental contract is easily made and can cause many problems. Therefore, always ask a lawyer for advice when drawing it up.

Drawing up a rental contract
A standard rental agreement first states who the tenant and who the landlord is. It states what the rent is (possibly broken down into service costs and basic rent) and the time and method of payment. It is also important to make good agreements about maintenance, house rules and the rent increase. In addition, record what the condition of the house was before the rental, so you avoid discussions about leaving the house in its old state. Drawing up a good rental contract ensures that no one is faced with surprises.
