Preliminary purchase agreement
When the seller has agreed to the offer made by the prospective buyer, you can conclude a provisional purchase agreement before the purchase is final. This agreement contains all agreements that have to do with the sale of the property. Think of the purchase price and the date of the key transfer. A provisional purchase contract is a binding contract, but do not let the word "provisional" fool you. "Provisional" refers to the fact that the property has not yet been definitively transferred to the buyer. The purchase is only a few steps away because the delivery or transport deed still has to be passed. In addition, the legal cooling-off period of three days for the buyer is still in force. The buyer does not have to give a reason for this.
What also falls within the provisional purchase contract is the obligation to investigate that the seller may carry out. The buyer must indemnify the property in question. In the indemnification, the seller declares that the property is habitable. The seller also has a duty of notification. This reveals, for example, damage and hidden breakages.
Resolutive conditions
Within the provisional purchase agreement of real estate, the resolutive conditions are an important part. This means that the buyer has the opportunity to get out of the purchase agreement as soon as a number of conditions are not met. In most cases, this concerns financing. If the buyer does not complete the financing, the purchase agreement may be dissolved. It is therefore advisable at all times to seek legal advice when buying or selling a property. This prevents you from overlooking something and perhaps being faced with an unpleasant surprise afterwards when something turns out not to be right, for example.
