Dutch tenancy law is codified in book 7, title 4 of the Dutch Civil Code. Tenancy law consists, among other things, of general provisions that apply to all lease agreements. Parties can deviate from the tenancy law as described in the law, provided that the parties have agreed this in the rental agreement and deviation from the law is permitted by the legislator. In addition to provisions for which deviation is permitted, the legislator has also codified a large number of provisions in order to protect the tenant when renting living space and business space from which it is not allowed to deviate, this is also called mandatory law. In addition to provisions regarding living space or business space, tenancy law also regulates the renting or letting of a piece of land, storage space, a car or a bicycle. The obligations to which the landlord and the tenant must comply under the law are extensive and complicated.
