Legislation
Employment law regulates the relationships between employee and employer that is based on Dutch legislation and case law. A large part of this legislation is mandatory in nature, this means that it is not allowed to deviate from this legislation, which therefore offers protection and rights to the employee. These protections and rights reduce the power difference between the employee and employer, so that the employee often occupies a strong legal position. Our advice is therefore to make use of these rights and protection at all times. Dismissal a major event If you are dismissed as an
employee, this has direct consequences for your private life. You will end up in an uncertain period, in which it is still unclear how your dismissal will be arranged and whether you can claim unemployment benefit and severance pay. Make sure that you always get legal support so that you come to a correct solution and if the employment contract is terminated that your right to unemployment benefit is secured and a fair real severance payment is in return.
Dismissal how does that work?
Are you dealing with an (imminent) dismissal? Then it is important to know that your employer cannot just fire you. First of all, your employer will have to have a good reason for dismissal. If your employer has, or thinks, a reason for dismissal, he will have to start a dismissal procedure in order to actually be able to dismiss you.
Mutual consent
Often your employer will try to avoid a dismissal procedure. Your employer then wants to terminate the employment by mutual consent. Your employer does this by offering you a dismissal proposal, termination agreement or a settlement agreement. The employer may also ask you to give written consent to the dismissal.
Our experience is that it regularly happens that an employer puts a lot of pressure on the employee to quickly agree to your dismissal. Never agree to that immediately!
