What is civil law?
When we talk about civil law, we are talking about matters that citizens have among themselves, organizations and individuals and organizations. In a civil case, the hearings are usually public. Civil law has two different procedures: the summons procedure and the petition procedure.
Civil Code
Dutch civil law is largely laid down in the Dutch Civil Code. Dutch civil law derives from the "Code Civil" from the time of Napoleon. Initially, the Dutch Civil Code was no more than a translation of this French Code. In the second half of the 20th century, the rewriting of the code began, under the direction of Leiden professor Eduard Meijers, who died in 1954. In 1992, this "New Civil Code" was largely put into use. The idea behind this "NBW" was not primarily to change the content of the law, but to record this in a clearer way, in order to promote, among other things, legal certainty.

Civil procedure
There are two different civil proceedings, namely summons procedure and petition procedure.
Subpoena proceedings
A subpoena procedure is a legal procedure before a court, which is initiated by one party issues a summons against another party. One party is called the plaintiff and the other party the defendant. The subpoena is a document in which the plaintiff describes what he or she requires of the defendant, the grounds on which that claim rests, and the manner in which and the period in which the defendant can respond.
The summons is generally conveyed to the defendant by a bailiff. This is important, because it must be guaranteed that the defendant actually receives the summons (on time). The plaintiff must also be able to prove this, because otherwise the judge will not even deal with the content of the case. In many countries, including the Netherlands and Belgium, the summons procedure is the most common procedure in civil law. The term subpoena proceedings usually refers to civil proceedings, although criminal proceedings may also begin by issuing a summons to the accused.
Petition procedure
A petition procedure is a judicial procedure that is initiated with the filing of a petition with a court. This distinguishes it from proceedings initiated by means of a summons or notice of appeal. In the Netherlands, the procedure has traditionally occurred in civil law and since 1 July 2013 also in administrative law.
The petition procedure is in some ways similar to the subpoena procedure. Here we only speak of an applicant and a defendant instead of a plaintiff and a defendant. In an application procedure, the applicant asks the court to take a decision. One can think of invoking a certain legal situation. These procedures are now common in relation to matters of personal and family law.
