Traffic fine
Millions of traffic fines are issued every year. These are not always justified, even if you think you have committed the violation, it may still be the case that the check has not been carried out correctly. A successful appeal to the Public Prosecutor, the subdistrict court, or the Court of Appeal in Leeuwarden is difficult to predict in advance, because your dossier must be thoroughly examined for this. Nevertheless, the chances are not necessarily small that, on the basis of facts and circumstances, the fine will still end up in the trash. So objection always makes sense.

You will usually receive a parking fine from the municipality. You can lodge an objection within 6 weeks of the date of the letter in which the fine is made known to you. Send as much evidence as possible with your objection (for example, photos, the parking ticket or witness statements). The fine states where you should send your objection. If your objection is rejected, you can lodge an appeal with the tax chamber of the Court of Appeal within 6 weeks of the date of the decision on your notice of objection.

'Mulder Law' fine
A parking fine can also be a Mulder Act fine. You can recognize this by the letter M at the top of the letter with the fine. If you pay the fine, you can no longer object. By paying, you indicate that you agree with the fine.

Decision
Minor traffic violations are usually dealt with a fine. You will then receive a fine from the police or a parking attendant. For example, you will find the fine under your windscreen wiper or you have been recorded by a speeding camera. In all these cases, you will usually receive a decision at home from the Central Judicial Collection Agency (CJIB) within 4 months. This is a form with an giro acceptance form, which states what offence you have committed, what you have to pay and before what date. If you are recorded by a speeding camera in a rental car, the decision must be received within 8 months.

Objection to a fine

There are many reasons why an objection can succeed, a fine can be reduced or destroyed. Here are some examples:

  • Sometimes the signage on the spot is unclear with the result that the fine is annulled, in order to see such a ruling.
  • Sometimes the public prosecutor does not make it to decide on the objection within the objection period, the result may be that the fine is annulled.
  • Sometimes there is wrongly no question of a standing posture. The fine can then be annulled in order to see such a ruling.
  • Many fines are annulled due to the circumstances of the case.
  • In the case of call parking  (e.g. Parkmobile or  Yellowbrick),a reasonable time must be given to activate the parking. If one does not get that time, there is a good chance that the fine will be annulled, to see such a ruling.
  • Etc.

Objection, appeal, appeal.
