Administrative law
The relationship between the Dutch citizen and the government is governed by administrative law, which is codified in the General Administrative Law Act, among other things. The General Administrative Law Act contains provisions that administrative bodies must comply with, as well as rules that offer legal protection for citizens against decisions taken by administrative bodies. In addition to the General Administrative Law Act, there are many special administrative laws, such as the Traffic Regulations Enforcement Act.
Administrative right of objection
The applicant for a permit or an interested party can submit a notice of objection to the administrative body that took the decision if the applicant or interested party does not agree with the decision taken. The administrative body will then look at its decision again and if it is a good objection, the objection can be declared well-founded so that the citizen still gets his right. However, if the administrative body stands by its decision and thus declares the objection unfounded, the citizen can go to the administrative court and dossier a notice of appeal there. In extreme cases, the citizen can even appeal to the Council of State in The Hague.
Administrative law procedure
You can be assisted by a lawyer in administrative proceedings, because a lawyer is not obliged in administrative law. In addition to the previous proceedings, a citizen can also dossier an interim injunction against an administrative body to deny the operation of a decision taken until a decision on objection or appeal has been taken.
